ARBITRATION AND INABILITY TO PAY

A party’s lack of financial means does not preclude the enforcement of the arbitration agreement but may be taken into consideration during the review of the award, particularly with regard to the right of access to the courts. Is the current state of the law satisfactory? Are there any necessary or relevant criteria for determining a party’s lack of financial means in arbitration? Should a distinction be made depending on whether the lack of financial means affects the claimant or the respondent? How should or can arbitration participants adapt depending on whether the arbitration is ad hoc or institutional? To what extent can foreign solutions serve as a source of inspiration?
These are among the questions that the Arbitration Practice Group intends to address, based on a scholarly paper provided to each participant, who is invited to engage in an open discussion.
