The symposium aims to examine the relationship between arbitration and criminal law from the perspective of disruptions to the arbitration process caused by the existence of a related criminal proceeding. The nature and extent of these disruptions depend on the type of offense. In a first set of cases, the very validity of the arbitration is called into question due to fraud or the misuse of arbitration. In a second set of cases, the arbitrators must rule on the civil aspects of criminal offenses committed by the parties or one of them, which have an impact on the resolution of the dispute. The focus will primarily be on commercial arbitration, but investment arbitration will also be addressed. Procedural and practical aspects will be central to the conference, which will feature presentations by experts in arbitration as well as specialists in criminal law and criminal procedure.
