EXAMINING CONSTITUTION AND REVELATION

Challenges based on irregularities in the constitution of the arbitral tribunal are becoming increasingly common, whether they concern compliance with the principle of equality of the parties in the appointment of arbitrators or, in particular, the principle of the arbitrator’s independence and impartiality. In reviewing the regularity of the constitution of the arbitral tribunal, the court is required to interpret not only the parties’ agreement but also the provisions of the applicable arbitration rules, the latter playing an increasingly important role in determining the criteria for assessing the independence and impartiality of appointed arbitrators or the scope of the duty of disclosure, as evidenced by recent case law. Recourse to the supporting judge and that judge’s powers are also a source of significant litigation. This underscores the importance of examining appeals based on irregularities in the constitution of the arbitral tribunal, a topic the Arbitration Practice Group invites participants to explore during an interactive seminar, in which practitioners, judges, and academics are invited to freely participate based on a scholarly paper prepared by the moderators.
