INTERIM MEASURES IN ARBITRATION

The discussions will be moderated by the group’s chairs, Jacques Pellerin and Henri-Jacques Nougein.
As essential as they are in domestic and international arbitration proceedings, interim and protective measures are not easy to handle due to the shared jurisdiction of state courts and arbitrators in ordering them. While the sequence of the statutory provisions suggests a chronological division of jurisdiction depending on whether the matter concerns the phase prior to or following the constitution of the arbitral tribunal, exceptions exist in both situations, so that the parties may sometimes be unsure of whom to approach effectively. Furthermore, the development of expedited procedures and emergency arbitration contributes to the complexity of understanding the content and framework of interim measures. To what extent can the parties’ contractual provisions derogate from the general jurisdiction of state courts or arbitrators? What about ex parte measures? Is the use of an emergency arbitration proceeding always the most appropriate choice in terms of the measure’s effectiveness? In practical terms, are there specific characteristics regarding the content of interim measures in arbitration? Is it conceivable to develop a genuine “interim measures strategy”?

It is around these questions, in particular, that the Arbitration Practice Group invites practitioners and academics to engage in an open discussion during this workshop on interim measures in arbitration, based on a set of supporting materials that will be provided to all participants.
