The Impact of Appeals on the Enforcement of Arbitral Awards

The discussions will be moderated by the group’s chairs: Claire Debourg, Laura Weiller, and Vincent Chantebout.

The relationship between the enforcement of an arbitral award and the exercise of a right of appeal was profoundly altered by the decree of January 13, 2011. Thus, the new division of powers between the First President and the Pre-trial Judge in ruling on the suspension of an award deserves particular attention. Similarly, in domestic matters, new statutes regulate—without reference to the provisional enforcement of judgments—the suspension or the ordering of provisional enforcement of arbitral awards. The framework and procedures for granting such provisional enforcement, as well as those for suspending it, give rise to a substantial and ongoing body of litigation. What can the parties do to optimize the effectiveness of this enforcement phase? In international matters, while the suspensive effect of appeals has been eliminated, the immediate enforcement of an arbitral award—which may be accompanied by any provisional or protective measures that may have been ordered—can still be halted or modified if it is “likely to seriously prejudice the rights of one of the parties,” a concept that is sometimes difficult to define. The issue of enforcing foreign awards, particularly when they have been set aside in their country of origin, still calls for special vigilance. The same applies to decisions resulting from extraordinary remedies, which raise unprecedented questions. It is around these topics and a few others that the arbitration practice group invites practitioners and academics to engage in discussion during an interactive seminar, supported by a informational booklet that will be provided to each participant.
